DVAG offers its clients tailor-made financial and investment strategies through its extensive network of 37,000 commercial agents within the meaning of § 84 Handelsgesetzbuch (the German Code of Commercial Law), providing a wide array of consumer insurance, annuities, savings and financing solutions, and mutual fund investment options. These commercial agents act independently, on a commission basis, but are assisted by DVAG by providing them with a common corporate identity and marketing platform, IT-Infrastructure, accounting settlement systems and comprehensive, quality education and training. A. The name and brand DVAG Since Professor Dr. Reinfried Pohl opened his family business in 1975, the name Deutsche Vermögensberatung has been associated with an unparalleled level of customer service and client satisfaction. DVAG assesses its clients’ individual requirements and uses these as a basis for long-term consulting in the areas of old-age pension provision, wealth management, health insurance, non-life insurance, loans and mortgages, and banking. Professor Dr. Reinfried Pohl, in creating the DVAG company, developed an innovative approach to client financial management known as the “ALLFINANZ-Konzept.“ The “ALLFINANZ-Konzept” is a holistic consulting approach that covers all economic and financial questions for DVAG’s private clients. Deutsche Vermögensberatung holds a trademark registrations No.: DE 395 106 43 for the wordmark DVAG in Germany with priority of March 13, 1995. This mark is used in connection with DVAG’s client consulting services, to identify its commercial agents as authorized agents and to advertise the unique consulting services offered by the company. The ʺ.DVAGʺ top-level domain will enable Deutsche Vermögensberatung to communicate with all of its commercial agents in a streamlined and consistent manner, and to communicate information about the DVAG brand in single and a unified platform. The ʺ.DVAGʺ top-level domain will further assist DVAG by providing a single location where clients may locate and engage authorized investment counsellors, research the many products and services offered by the company, and where commercial agents may advertise in a DVAG-endorsed, authenticated space. The ʺ.DVAGʺ space will provide the company and its agents with a single, multi-functional and well-maintained forum through which to communicate to their clients and prospective consumers. The TLD ʺ.DVAGʺ is intended to benefit Internet users by enabling DVAG and its commercial agents to communicate under the unique nexus ʺ.DVAGʺ more easily and effectively with all Internet users, and particularly with their many customers, employees and affiliates. The ʺ.DVAGʺ Registry Service Provider will manage the Internet space under the direct control of DVAG. This will allow the distribution and exchange of information between DVAG, their authorized commercial agents, and their relevant stakeholders by means of, but not limited to, websites, social networks, email and other technologies that will reside within the ʺ.DVAGʺ domain name space. DVAG envisages the TLD to follow a single-registrant model, wherein all registrations within the space are held by the DVAG company itself. DVAG’s commercial agents, appropriate corporate divisions, or other affiliated entities may apply to the Legal department of DVAG to request authorization to license such registrations for their own use. DVAG shall review such requests and, in its sole discretion, may grant such licenses on a case-by-case basis. In all cases, DVAG shall monitor the use of all ʺ.DVAGʺ domain names to ensure that the content of the associated websites remains current and appropriate to the ʺ.DVAGʺ space, and does not violate third parties’ rights. Furthermore, all host records have to be approved by both the legal and the IT department of DVAG prior to creation. |
